1. Acceptance of Terms
By accessing or using Lawfair ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
Access to Lawfair is by invitation only. By accepting an invitation and creating an account, you confirm that you have read, understood, and agree to these terms.
2. Description of Service
Lawfair is an AI-assisted legal analysis platform designed to support Scottish civil litigation. The Service provides:
- Adversarial analysis of civil litigation cases under Scots law
- Outcome prediction and legal risk assessment
- Identification of relevant legal issues and authorities
- Quantum and expenses analysis
- PDF export of analysis reports
Lawfair is a decision-support tool only. It does not constitute legal advice and should not be relied upon as a substitute for professional legal advice from a qualified Scottish solicitor or advocate. All outputs must be reviewed and verified by a qualified legal professional before being used in any legal matter.
3. Account Registration
Access to Lawfair is restricted. You may only access the Service if you have been granted access by Lawfair. To request access, complete the access request form at /request-access.
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorised use of your account
You must not share your account credentials with any other person.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
- Use the Service to obtain legal advice for personal use without professional supervision
- Upload confidential or privileged information belonging to a client without appropriate authority
- Attempt to reverse-engineer, copy, or reproduce the Service or its underlying models
- Use the Service to train, fine-tune, or develop competing AI systems
- Upload content that is unlawful, defamatory, or infringes third-party rights
- Attempt to circumvent any security or access controls
- Use automated tools to scrape or bulk-download Service outputs
5. Your Data
Case data: Factual narratives and documents you upload are processed solely to generate your requested analysis. They are not used to train AI models. We use Anthropic's API with a zero-retention policy — Anthropic does not store or use your inputs for model training.
Confidentiality: You are responsible for ensuring you have appropriate authority to upload any confidential or privileged material. Lawfair will implement appropriate technical and organisational security measures to protect your data, but cannot guarantee absolute security.
Data retention: Analysis results are retained for the period your account is active, plus 30 days after account termination to permit data export. See our Privacy Policy for full details.
6. Intellectual Property
The Service, including its software, models, prompts, and outputs, is owned by or licensed to Lawfair. Analysis outputs generated by the Service are provided to you for your professional use but Lawfair retains rights in the underlying methodology and system.
You retain ownership of the factual information and documents you upload.
7. Disclaimers
The Service is provided "as is" without warranty of any kind.
Lawfair does not warrant that:
- Analysis outputs are accurate, complete, or current
- The Service will be uninterrupted or error-free
- Outputs reflect the current state of Scots law
AI limitation: The Service uses large language models which may produce incorrect, incomplete, or outdated legal analysis. All outputs must be independently verified. Judicial decisions, legislation, and legal principles change — the Service's knowledge has a training cutoff and may not reflect the most recent law.
No legal advice: Nothing in the Service constitutes legal advice. Outcomes predicted by the Service are probabilistic estimates only, not guarantees.
8. Limitation of Liability
To the fullest extent permitted by Scots law, Lawfair's liability to you for any claim arising from these Terms or your use of the Service is limited to direct losses only.
Lawfair is not liable for:
- Indirect, consequential, or economic loss
- Loss of profit, revenue, or anticipated savings
- Loss arising from reliance on Service outputs without independent professional verification
- Any claim arising from a failure to obtain a legal outcome
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
9. Indemnification
You agree to indemnify and hold harmless Lawfair, its officers, employees, and agents from any claims, losses, or damages arising from:
- Your use of the Service in breach of these Terms
- Your upload of content that infringes third-party rights or breaches confidentiality obligations
- Reliance on Service outputs without appropriate professional review
10. Termination
Lawfair may suspend or terminate your access to the Service at any time, with or without notice, if you breach these Terms or for any other reason at our discretion.
You may request account deletion at any time via Settings. Following account deletion, your data will be deleted within 30 days, except where retention is required by law.
11. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email or in-app notification. Continued use of the Service after notification constitutes acceptance of the revised Terms.
12. Governing Law
These Terms are governed by the law of Scotland. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the Scottish courts.
